Can an employer give a 13 year employee notice of termination and offer of continued employment without a payout?

It will depend on the circumstances. The notice you are entitled to could be determined by a termination provision in your employment contract. If there is no enforceable termination provision, you would likely be entitled to common law notice. Common law notice is calculated taking into account a variety of factors, including age, length of service, and position.

Employers are permitted to give employees working notice of termination (as opposed to pay in lieu of notice). However, if you are entitled to severance then your employer is obligated to actually pay that amount to you.
