I have been off of work due to a disability for 10 months. My employer is asking me when I will be returning. I am still not well enough to return. How long does my employer have to hold my job for?

Thanks very much for your question. While there is no one-size-fits-all answer, employers do have an obligation to hold your position for you as long as your doctors believe you will be able to return to work in the reasonably foreseeable future. That may be 2 or 3 years, or even 4 or 5 in some cases. If your employer is beginning to give you a hard time, make sure you give us a call and discuss your situation with one of our lawyers.
