I am submitting a question I sent last night but was not sure it would be recieved after hours. I am providing additional information. I am terminating someone who has been with me for 2 years and 10 months. They are entitled to 2 weeks vacation per year. Their last vacation was 2 weeks in August of 2015. Since then they have taken 2 vacation days. How many weeks of termination pay and how many weeks of vacation pay would they be owed. We are a small company and we are not required to pay severance. I am meeting with this individual this morning and I have already consulted with our company accountant but I saw your web site and was interested in a second opinion.

To determine how much termination pay you should provide this individual, I would need to learn more about this individual's circumstances. Further, when terminating an employee, it is important to have them sign a Release such that they cannot sue your company for wrongful dismissal after receiving the termination pay.
