I wish to terminate an employee who was aggressive with a customer. She has worked for me for approx. 14 months, but was on sick leave for a month (ROE was provided) and just returned about four weeks ago. Is her sick leave considered a break in employment, or do I have to give her pay in lieu from the moment she was initially hired?

Her sick leave is not considered a break in employment and, at law, she should receive a severance based on her 14 months of service. Please contact us at the number below for a consultation with a lawyer to discuss your matter further.
