I’ve been working for a very high profile medical legal private association for 24 years. I’ve been the Supervisor of my department for at least 13 years. The environment is very stressful, HR practices are unbelievable even to the point of hiding sexual harassment complaint from several women against one man in particular (he is still working there). I am presently off on medical leave due to burn out, anxiety and depression. I’m trying to get myself the courage to return to work but the more I think of the environment the sicker I get. It’s almost a year that I’ve been off. Since being off I’ve been made aware of layoffs of other supervisor managers that have been there for 15 plus years. My question is can they do the same to me while I’m off on medical leave? Because I’m aware of bad practices in the work place and I’m a rape and sexual abuse survivor I’m terrified to go back and work there again. What are my rights

Employees who are off on medical leave can still be terminated. The important factor is whether the termination is related to the leave or underlying cause of the leave. If it is, then it would be a discriminatory termination and the employer could be opening itself up to possible Human Rights damages.
