Had a young employee that had worked for the company for less than one year. She handed in her written resignation giving two (2) weeks notice but when asked to come in a discuss her reasons for leaving, she became heated and stated "well, I guess I'll just leave today" - she had left the studio unattended to take care of a personal matter, but did not contact or try to contact another employee to take over in her absence. Her comment "I guess I'll leave today" was accepted by her manager. Is she entitled to any termination pay?

Thank you for your question. Given the information that you have provided you would not owe the employee severance. Not only did she hand in a written resignation but it is also arguable that she abandoned her position. We would be happy to set up a consultation with one of our employment lawyers to discuss further. Otherwise, never hesitate to call us directly should you have any employment questions in the future.
