My company has now mandated vaccination for all employees. It is not government mandated just our company. My employee has presented a doctors not that he needs to wait to see another doctor in a few months. 1. Are we able to put him on a leave of absence without pay? We aren’t firing him
2. Would we be violating human rights at that point? 3. Would he be able to sue is after?

Thanks,

Jessica

As an employer, you are obligated to accommodate an employee with any medical restriction they present. In this case, it could include testing as an alternative to vaccination in the interim. An unpaid leave of absence could constitute a constructive dismissal. Please contact our firm for a further consultation to discuss your options.
