I own a small business, one employee claims he injured his shoulder at work and went to hospital with no witnesses, the xray came back fine and is being sent for a specialist opinion. Doctor said 8 to 14 days off work... employee shows up to site with paperwork and had nothing but attitude and started harassing the employer to the point of threatening him with physical harm. There were witnesses to this and it also seems planned. Should this employee be terminated during an injury investigation?

I strongly advise against dismissing the employee at this time. Instead, I recommend a firmly-worded disciplinary letter and I encourage you to contact our firm to arrange a meeting with one of our lawyers to discuss options and next steps given the complexity of the matter.
