I am on temporary lay off since April due to COVID. The company recently laid off several others with no date of return in site. We do know however, the company is in bankruptcy as it has been in the news. With no hopes of going back to work the company has not provided any paperwork or verbal of the severance or termination package. They are waiting it out and soon will have no money. Benefits were stopped in late September saying they only need to pay into our pension at this time. Is this true?

If the Company has formally commenced bankruptcy proceedings, you would become an unsecured creditor with respect to your claim for severance. Accordingly, it is highly unlikely that you will receive anywhere close to your full severance entitlements.
