Paid as a contractor at a local church to play the organ at services. 10 weeks in, in an unrelated conversation I initiated with the pastor, I'm told I will no longer be paid due to no money. However, 2 other musicians will continue to be paid because they were hired before me. I am still owed $150 which I'm told will not be paid either. I'm 68, a life-long church organist. There are basically no jobs in the area. This new pastor will not comment on the subject. I believe he is being counselled by the financial committee chair who, with the pastor, fired me in 2022 for no cause. At the time, the pastor was suffering from early stages of dementia and the chair was basically full of himself! I assumed that was how I came to be dismissed since the situation made no sense to me or my "witness" at the dismissal meeting. Now 4 years later, I'm left with no job and even though I've suggested I would play for free till things turned around, I have been rejected. Again, I believe this is the work of the chair yielding his "power."

I am seeking a legal opinion on whether this constitutes Constructive Dismissal or

I am seeking a legal opinion on whether this constitutes Constructive Dismissal or Promissory Estoppel, and whether the "exclusive jurisdiction" of the union can be bypassed since this involves an individually negotiated retention contract that the union admits falls outside their scope.

In 2022, I received a formal job offer from an external employer. To retain me, the employer negotiated a permanent 4-day-per-week remote work arrangement. This was not a standard hybrid application; it was an employer-initiated retention measure. I have documented approval from my Director stating the schedule would "continue past the pilot" and an official document with an end date of December 31, 2050. I relied on this specific promise to my detriment by formally declining the external offer.

The emplyer is now unilaterally rescinding this arrangement, mandating a 4-day-per-week return to the office starting in 2026. In November 2024, I was asked to sign a letter labeled as an "extension" of this "temporary" arrangement. However, I received no new consideration (no raise, bonus, or benefit) in exchange for signing this letter, and I maintain that the 2022 agreement remains the governing contract of my employment.

I am the original owner of William Tissert (since 2013). Under the guidance of my

I am the original owner of William Tissert (since 2013). Under the guidance of my accountant, I closed my business in 2024 after assuming a large amount of debt resulting from the pandemic. My accountant’s spouse then opened a new business where we worked as partners (verbal 50/50 agreement) under the name of William Tissert Salon.

Last month I informed my business partner that I was planning to move to the Niagara region over the coming months and that I would like either for her to either purchase my 50% of the business, or that we should sell the business and then split the proceeds. It is at that point when I was told by my accountant that my name was never registered and therefore his wife was the sole owner. His wife then proceeded to remove my title as co-owner from our social media platforms and to inform the staff and clients of the same.

My questions are therefore to understand how to calculate the duration of my employment under the law. I did not receive any severance after my initial business was closed, nor did I sign an employment agreement for the new business. Am I therefore considered to have been employed since the start of the initial business in 2013, or does the fact that I owned the previous business imply that the initial business cannot be considered when establishing the duration of employment? And secondly, given that I was demoted from the position of co-owner, would that be sufficient grounds to seek a claim of constructive dismissal?

The salon has become quite toxic since this commenced last month, and I am anxious to bring things to an end. Please advise on how best to proceed. I would be happy to meet with you to discuss further.

Sincerely,

William

Good Evening.

Good Evening.

As a successful salesperson for the same company for 10+ years, earning 400k plus I was asked to take over for my boss who was retiring. I was given 2 years of uncapped income, to basically do both my job and his. Shortly after I accepted my team saw their commission capped.

I signed a contract that reduces my compensation at the 2 year anniversary, which is coming up very soon. I had no choice to accept, as I had a very large amount at stake if I refused to manage as my commission would have been capped immediately, and I had sales worth about 800k in commission on the books but not paid yet.

They intend to pay me $200k a year in salary to manage the company with no commission once the anniversary passes, and thankfully I’ll be paid out for existing sales at year end.

As part of my compensation for the last 2 years, the only « perk » to manage is that I earn 1% in shares for every million in net profit after tax and expenses.

I figure this might be worth 400-500k by the time I intend to resign in December.

I’d like representation to ensure I don’t make any mistakes, and can get all I’m entitled to.

Fast forward to the following pay. My job deducted the 8 extra hours of pay without any discussion or authorization. Which resulted in my pay being $300 less then expected.
I am currently employed by a federally regulated company and am on short-term disability (STD) leave. During my STD leave, I submitted a workplace harassment and violence complaint to the company’s HR department.

However, HR informed me that based on an assessment report from the insurance company, proceeding with my complaint would negatively impact my health. As a result, they have decided to hold off on processing my complaint. Unless I submit a doctor’s note confirming that handling the complaint will not affect my health, then they will proceed my complaint

I am concerned about the legality of this requirement and whether the company is obligated to continue handling my harassment complaint regardless of my medical leave status.

Could you please advise:

Whether HR’s actions in delaying the complaint until a medical note is provided constitute a serious violation of the law?

Whether this situation amounts to disability discrimination?

Thank you very much for your time and assistance.

The company I having been working for since September 2020 is under new management, they took over in October of 2024. While I was away in February 2025, the company introduced a new extended benefits package, prior to this we did not receive additional benefits. When I came back I was told everyone in the company had to sign up, so I did. Not until after I signed up was I notified by another employe that I was responsible for paying for these benefits, I was under the impression that the company was paying for them, because no one had provided any payment information to me with the paperwork. It is now going to cost me $206 plus change - this includes my husband and I. If I had known that I was going to be out of pocket for these expenses I would never have signed the papers - the company has told me that it is mandatory to be signed up for benefits. I would like to know if this is correct, and I have to be out of pocket for these additional expenses.

Subject: Assistance with Workplace Harassment and Weekly Indemnity Documentation

Subject: Assistance with Workplace Harassment and Weekly Indemnity Documentation

Good afternoon,

I have been working at a non-unionized organization for four years, during which I was not provided with a collective agreement. Back in August 2024, I was chased outside my workplace, which has led to ongoing anxiety. Since then, there have been significant changes in the workplace, including what I believe are unjustified performance reviews, along with personal stresses.

As a result, I have been on leave since February 2, 2025. However, I am experiencing harassment from my workplace through unnecessary emails. Recently, they informed me that I am on Weekly Indemnity and requested documentation from a psychiatrist. Unfortunately, my psychiatrist is unable to complete these forms due to having insufficient time to evaluate me fully.

I would appreciate your advice on the following:

What are my rights in this situation regarding the harassment and excessive communication from my employer?

How can I manage their requests for documentation when my psychiatrist is unable to provide it?

Are there any legal protections or steps I can take concerning the issues I’ve faced at work (e.g., anxiety from the August 2024 incident, workplace changes, and performance reviews)?

Thank you for your guidance.

I didn’t quit, while I was looking for other employment I had not put in my two weeks notice yet. The biggest reason they gave me, was my recent streak of absences due to being sick. Stating my recent mental health day was an excuse. They never wrote me up for absenteeism or anything related to what they said at the time. I had reported them prior to the health and safety board for harassment as well. They never gave me written notice about my dismissal either despite being required to by law.
Hello
In regards to Bill 124

I worked as a manager for the LCBO from 2015 to August 2023. I resigned, in good standing. (non union position)
They have recently paid the managers "retro" pay for the correction of Bill 124.

Am I ? / I feel I am entitled to the retro pay as I had worked with the LCBO during the Bill 124 period of 2019 to approx 2022.

Is there a legal potential for me to be entitled to the retro pay?

Thank you

Hi, I was injured in a car accident and my doctor recommended a shorter work week (medical note was provided). My employer has retained the services of the third party disability management company which has forced me to sign their consent form using threatening language such as "otherwise your file will be closed for non-compliance". They now hold the right to endlessly investigate my condition and question my health practitioners at my expense. As I am on medical leave without pay I am not entitled to apply for any disability insurance, therefore I am not certain as to why they are repeatedly requiring paperwork given my absence for one day a week has no apparent cost for the company. I feel like the whole procedure is aimed at wearing me down with paperwork and fees. Is this legal? Do I have any recourse? Should I comply? I would really appreciate your input. Thanks

I contested this by showing evidence that not only was the PIP unwarranted but also that my job role had been inaccurately classified. I pointed out that my work was being judged at a managerial level even though I'm in an individual contributor (IC) position. Additionally, I voiced serious concerns about discrimination and unequal treatment at the company. Following my objections, the company revoked the PIP and has since made efforts to be more accommodating and to address the discrimination issues I brought up.

Despite the company's recent shift to a more accommodating stance, I'm still uneasy about the possibility of being terminated in the future, perhaps during an upcoming layoff or organizational restructuring. This concern stems from discussions with former colleagues who experienced a similar sequence of events: their PIPs were withdrawn, only for them to be terminated later, seemingly as part of broader layoffs. This recurring pattern has me questioning my position and the kind of exit package I might be able to secure should my employment come to an end.

Given these circumstances, I wonder if your firm could would be able to me in negotiating a significant exit package, leveraging the issues of discrimination and job misclassification I've previously raised? Or, am I likely to be offered the standard severance package given to others in a layoff situation? Could hinting at legal action at that point assist in securing a substantial exit package, even if the company maintains that it has resolved the issues I highlighted? Would liability on their part still exist?

I've considered negotiating an exit now, but I've only been with the company for a year. Would it be wiser to wait?

I have been working for a dental office for more than 30 years. I am the manager. I was responsible for payroll, account payables, all accounting for the office and 2 of the dentists' corporations. I do all the tax also. The office was sold Jan 31, 2024 and I no longer do any financial things. I just supply the staffs payroll information. Is this considered conductive dismissal? Also I believe the new owner plans to eliminate our medical benefits. The owners pay for employee premiums. Can they eliminate benefits without notice? Also I am on salary and not paid hourly. The new owners and I seem to have a different opinion on what that means. Can you clarify that as well?

I've got a check for those 2 weeks, so when i asked them to give me a contract they said that they don't do it. Officially they have not fired me yet but they will do it next week ( all problems started after i had an epilepsy episode at work time and they were worried and for the next two days were talked about and after these 2 days all this started. I will appreciate any information. Thank you

I was on EI and then got a job at Great Clips as a hairstylist. It was very toxic work environment. Throughout my 3 weeks working there, I encountered a pattern of behavior that has significantly impacted my mental and emotional well-being. Instances being under constant video surveillance, and intimidation were not isolated events but rather a recurring theme that created an untenable work environment. So I had to quit after 3 weeks. After I quit, I was provided with a termination letter thru email. I was wondering if I can go back on EI again?

I am 54 years and have been employed with my employer for 5 years and have a good sick record. Due to Covid I had a previous vacation cancelled in 2020 with only a credit provided which had to be used by the end of 2023. Knowing that this credit need to be used this year I requested that I could could take a leave of absence of 3 weeks unpaid in conjunction with my scheduled vacation period. The employer has granted several leave(s) of absence to other employees for several months at time over several years, so I believed that I would have my request granted and was forthright with my reason for the request in its entirety realising it did exactly fit within the Leave of Absence Guidelines (ie Family emergency, Medical, etc..). My employer refused the request.
As a result I was left with the only alternative of calling in sick for the extended period in order not to loose thousands of dollars. I subsequently went on the vacation and upon my return two letters were hand delivered to my address indicating that I could not return to work without a letter from a doctor for my absence. Now that I am home and want to return to work what are my options and I am not going to get a lie and get a doctors letter. I do not have any sick benefits and presently now not able to make an income.

Hello, I am the HR Manager for the company. It is a family run business. I just started last week as they never had a HR department before. My question for you is that employees who are salaried, that come late consistently, can they have deductions in their pay? is that legal? Also for sick days, we know that in ontario, employees can get up to 3 unpaid sick days full time or part time employees, does this include hourly employees as well? what happens if they take the 3 days already and then what about the 4th? how do i create a policy based on this?

Is it ok to go to outside council to have an employment contract drawn up, or do we have to use the firm representing us for other items?
The Board of Directors needs an employment contract for a specific employee, has legal council already, but that council works closely with the employee in question, so it feels like a potential conflict to have them write this contract. (yes, the person is already employed, with no written contract in place)
Don't want to proceed though, if there is an obligation to that firm.

I have been working for the same company over 30 years, over 28 years for the same

I have been working for the same company over 30 years, over 28 years for the same position as highway shipping coordinator in the office. Recently company hired a supervisor whose position was vacant since 2009. My manager promised me that I will not be reported to this new supervisor. However, they did not keep the promise. Now I am reported to him. Not only he requests all emails communication involved him, also micro-managing all the emails and questions every single things. He made significant changes to the plant shifts, cancelled afternoon shift, created midnight shift and day shift with different shift hours (but these are unionized workers shifts with collective agreement) and also office hours. He even promised me my hours would not be changed, however, they made the announcement of the change after 2 hours of our discussion. I work as highway shipping coordinator hours Monday to Friday 8-5. another coworker GTA shipping coordinator (newly hired for 4 months) same hours. He changes my hours to 8:30 to 5:30 and the other coworker 7:30 to 4:30 (obvisously because she has child in day care). I talked to HR who supported me so now I can stay 8-5. Two days later, HR threatened that it would written warning for me influencing the workers to petition and voiced the complaint of change of hours to HR and company alert line (of course, I denied the statement & there was a groundless gossip) She also mentioned our office hours are confidential and should not be disclosed to the workers. Meantime, the supervisor again push me to prepare new "weekly shipping projection". Right now, I only schedule truck according to the various department of production, paintline, packing schedules on the next day basis, due to the fact Shipping is the end of the production process. Is preparing a "shipping projection" a supervisor/manager's task? He also demands me to train and switch job with the newly hired GTA shipping coordinator then I can work early shift of 7:30 to 4:30. I am not interested to go back to a shipping entry job and switch my job because it means double training and I will be responsible of two jobs at the same time. Am I responsible for training the other coworker? These two persons are both the same culture background, I feel I am isolated, and being bullies, harassed and teased everyday by this new supervisor. Whenever, I have input for his proposed task , he will suggest me being negative and resistant to change. Since then, I have symptoms of anxiety and depression. After today's doctor diagnosis, he gave me 3 weeks sick leave (company allows 3 days sick leave per year only) effectively today. I am not sure I will be qualified for short term disability over 65. What is my options for the employment if I choose to resume work but not to change role and change hours. After 3 weeks, I will resume work after sick leave and what is my right not to accept the change. I used to love my job and would like to work for 2 more years. Now they create the situation that make you feel stressful and wants you to quit voluntarily! Am I deserved severance pay ?

From what the complainant said, the employee has been challenging and harassing him through social media. He sent screenshot copies of the social media statements he was concerned about. From what was received, I don't see that she said anything inappropriate, rather asked him, who is a political leader, to do his job better. This is from the one article that was provided. Its not in employee’s character to be publicly inappropriate, but it is a concern for the society, and because of the political nature, its more concerning. There’s not enough information to really make an informed decision. Being that he called her employment to complain, he wanted her to be in trouble, and or fired. I don’t know if it escalates the situation. He wanted some kind of punitive action against her.

I have been on short term disability for the past 4 months due to mental illness. The company paid for the first 13, after that the third party consultant company my company hired to deal with my case did not approve my case even though the doctor said I was not ready to go back to work. I contacted HR and said that I was going to apply for EI Sickness Leave Benefit program. My employer granted me a 2 month leave with no pay but I am still entitled to benefits (health & dental). They sent me a letter confirming the 2 months off but also notifying me that if I don't show up for work at end of 2 month (July 23) that I will need to resign.
I was not expecting them to ask me to resign while I am still not ready to go back. I need my benefits to pay for medical expenses. I have been with this company 6.5 years for the first 5 years I was on contact, then became full time.
Any information or guidance would be appreciated

I run a small warehouse. We have 3 employees total. 1 manager, 1 office worker, 1 warehouse worker.

The warehouse worker injured himself at home (he fell down some stairs). According to his doctor, he is unable to do manual labour until he recovers. He is requesting we put him on "light duty" for the next 4 to 6 weeks while he recovers.

Unfortunately, we don't have anything in the way of "light duty" work as it is a small warehouse with only 3 positions.

My two remaining employees are confident they can cover for the injured employee while he is away healing, but the injured employee doesn't want to lose the income, and seems to think that we should have to find work for him so that he can keep getting paid.

My question is, am I obligated to allow this employee to keep coming in and working, despite the fact that we do not need him to do the work he'll be doing, purely so he can keep receiving a pay cheque from us?

I would like to know my rights please. I had a concern about a particular person

I would like to know my rights please. I had a concern about a particular person and voiced my concerns and complaints to my manager about bullying . My manager then made this particular person my supervisor, and the bullying and harassment continued . I voiced my concerns and complained to HR about the bullying , and asked to speak with her. HR refused and said she will speak with everyone at the same time. I voice my concern that I was being bullied in the meeting with all parties. About 30 minutes after the meeting was concluded I was called back to the meeting and this time my Supervisor and manager complained about me to HR. I tried to defend myself as what was being said was not true. HR said my Manager and supervisor must write up a letter to put in my file. How best do I handle this situation and is it reprisal?
