Add Comment Question: Hi there. I have a question about being sent home from work. I was to work a 12 hour shift but after 3 hours the power went off. After the power had been off for 2 hours my supervisor told us to go home. ( 5 hours worked) He said we would be paid for the shift. Now my employer is telling use we wont be. What is the legality around this? Do we just get paid for hours worked? Thank you! Answer: Thanks for your question. Regarding your question, yes you must be paid for time worked. If your employer refuses to do so, you may be entitled to treat your employment as constructively dismissed. If constructively dismissed, you would be owed severance. To get a sense of your entitlements, I would recommend you visit the severance pay calculator our firm has developed (www.SeverancePayCalculator.com).
