Can I fire an employee with a mental illness?
Thank you for reaching out to our firm.
You cannot fire an employee, in whole or in part, because they have a mental illness. However, an employee who happens to have a mental illness can be terminated, as any other employee, for reasons that are not related to their illness.
That said, these are still very complex scenarios and we would recommend that you obtain more thorough legal advice, via a consultation, prior to taking any such action. You do not want to risk a Human Rights Code violation or the like.
