I own a dance school two of my employees are opening their own dance studio. They are advertising and taking business away from mine. I cannot have them back as it will become a toxic environment and conflict of interest!

Hello,

Thank you for your enquiry.

My name is Chris Justice and I am a lawyer with Samfiru Tumarkin LLP.

In answer to your situation, and if you do not wish to have these employees around any longer, you have the ability to terminate their employment. However, should you choose to terminate their employment, you will likely be required to provide them with some form of termination pay (or, at the very least, notice of termination). Depending on whether or not they signed employment agreements (containing a non-competition clause, ideally) could also affect their termination entitlements.

In any event, I highly recommend you give me a call directly at 416-216-5859. From there I can gather more information and be in a better position to fully advise you as to your rights, entitlements, and options.
