Ask your question about terminations, dismissals and lay offs and an employment lawyer in Ontario, BC or Alberta will answer in minutes
Can an employee claim payment in lieu of notification and also claim wrongful dismissal?
He forged my signature among other things and abuse me verbally twice.
Thank you for your question. My name is Jon Pinkus and I am an employment lawyer at Samfiru Tumarkin LLP.
Payment in lieu of notice and damages for wrongful dismissal are the same thing, so if an employee is claiming both of those things against your company, that would likely be redundant. The question is whether the notice/payment in lieu that the company paid was adequate.
I would recommend booking a consultation with me to discuss your situation in more detail. Please email me at jon.pinkus@stlawyers.ca or give us a call at the number below.
