If an employee is telling other employees in front of customers that they are quitting, what are my resources. She wants to be fired so she can stay at home on EI and overlook what is going on at a home she is having built.

Hello,

Thank you for your enquiry.

My name is Chris Justice and I am a lawyer with Samfiru Tumarkin LLP.

In answer to your enquiry, if the employee quits, she would not be entitled to EI. If she is terminated for cause, she would not likely be entitled to EI (although in some cases individuals do receive the benefit). If she is terminated without cause, she would be able to collect EI.

There are other steps the employer can take, such as issue warnings that state should the behavior continue she may be terminated for cause.

If you would like to know more and have a complete picture of all of the options available to you, I recommend you contact me directly at 416-216-5859. From there I can schedule a consultation during which I can gather more information and be in a better position to fully advise you as to your rights and entitlements!
