Can an employer fire me if I got pregnant but they didn't know I was pregnant yet? Even myself at the time didn't know that I am pregnant (first trimester).

Thank you for your question. My name is Jon Pinkus and I am an employment lawyer at Samfiru Tumarkin LLP.

This is an issue that I have seen from time to time. If an employer does not know that you are pregnant at the time that they let you go, then it is unlikely to form the basis of a human rights violation. That being said, your entitlements to severance are going to be higher than usual. The law recognizes that it is more difficult for someone to seek employment when they are pregnant, and takes this into account when assessing how much severance you are owed.

I therefore recommend that you contact us at the number below, so that we can discuss your severance entitlements and ensure you get a proper severance package that takes into account your circumstances.
