Add Comment Question: If an employer terminates an employee with just cause and fails to produce evidence supporting this, does the company get fined by the Ministry of Labour or does EI document this to the Ministry of Labour? Answer: Thank you for reaching out to our firm. No, you will not be subject to fines from the Ministry. However, if you are terminating an employee and claiming just cause where you know there to be none or where none exists, then you may be liable for damages to that employee, in addition to reasonable notice of their termination, at common law. These can be substantial and common law damages are almost always well in excess of the Employment Standards Act, 2000 minimums that are enforced by the Ministry. If you would like to discuss a pending termination further, please feel free to contact me at kyle.shimon@stlawyers.ca and we set-up a time to discuss.
