Add Comment Question: Hi, my question is, do we have an obligation to pay our employee in this situation. He is a driver making deliveries. We are non-unionized. He is scheduled to work Wed, Thurs, Fri and Sat. He always gets work from us on Wed to Fri but his Sat shifts are often cancelled due to lack of orders. He usually works 11hrs on each of Wed, Thurs and Fri. We only know if Sat is cancelled by 3pm on Friday and we inform him then. Is there any obligation to pay him even a minimum amount since he did keep the day free for us? I would appreciate any help that you can give me in this matter. Answer: My name is David Vaughan and I'm an employment lawyer with Samfiru Tumarkin. You likley do not have to pay them for the Saturday in this situation. However, the answer to this question may change based on (a) whether the drivers have been paid in the past for this and (b) whether their contract of employment addresses this issue. Please contact our firm to discuss the matter in more detail. Your Comment * Your Email * Your Name * Your City Note, your name, city and email is not displayed on the website.
