Add Comment Question: Does an employee have to work during termination period? Let's say, less than a year and was generously given 2 weeks notice plus a cash bonus and employee not coming to work or even contacting. It's been a week now and the notice period hasn't yet been paid (due next week). Does the employer need to pay the 2 weeks any ways with now show up of the employee? Answer: If an employer provides working notice of termination, the employee must work that period of time. If he/she refuses to work, this amounts to a resignation. Before making any decisions regarding this employee, please contact our firm to discuss the matter further.
