Add Comment Question: I have worked for the same company for 21 years, I was just issued a new schedule with less hours, was not contacted I am the most senior employee with this company. The owner is trying to make me quit my job by making it difficult for me. He threatens all of his employees by informing them if they are not with him they will be fired. This man fired his own wife and son. He has given my shifts to an employee who has only worked 5 weeks with the company and makes more money than I do. There is more to this situation but I need to know what if anything can be done about my hours. Can they just cut my hours without notice? Answer: Hi Pam, Thank you for your question. From the sounds of it, it seems like you may have been constructively dismissed. This is where there has been a significant change to the terms of your employment, terms of which have been imposed on you without your consent. In the event an employee is constructively dismissed, they would be entitled to the same damages as though they had been terminated. Alternatively, it may be possible to have your hours re-instated without the need for litigation. In any event, I highly recommend that you give our firm a call. From there we can schedule a free consultation where we will be able to fully advise you as to your rights and entitlements.
