Add Comment Question: Hello I hope you might be able to provide some clarity to the following two questions. My mother is 71 years of age and it's been with her property management company for 12 years. They just handed her her termination papers and said that she is unable to collect unemployment insurance due to her age although she has been paying into it. What is more distressing is that in the letter it states she will be terminated as of November 15th 2018 which means from now till that date she is expected to work at the office in a toxic environment, train someone to take over the properties that she manages and that rather than give her Severance they're expecting her to work till November 15th at which time she will not receive any severance. I find this terribly unfair and it must be against the law. Could you kindly respond as this is creating a very toxic situation for my mother and at her age I'm very worried. Thank you very very much Answer: Hello, With respect to the EI issue, you should follow up with Service Canada to get more information, but since your mother is over age 65 there is a likelihood she would not be entitled to EI if she gets CPP payments from the government. Employers are entitled to provide working notice of an employee's termination. However, I highly recommend that your mother contact our office to schedule a consult with one of our lawyers so we can assess her termination package and determine her entitlements. With respect to the toxic work environment, a lawyer would need to fully review the situation with your mother to determine whether she has any recourse.
