Add Comment Question: I was let go from my position today for not showing up for a shift. I was told by one of my managers not to come in for the shift and that another coworker would be working it for me- and to feel better soon .. I had had a bad allergic reaction..(I have this conversation saved as it was over text) I was told by the general manager that it was my responsibility to work my scheduled shift and because I have had two prior written warnings for tardiness this was considered my third and As a result I was being terminated. (The employee who was asked by the manager to work my shift for me did so)In this meeting with my general manager I explained to her and tried to show her the conversation with the other manager where I said I was able to come to work but in the end was told not to come to work but she wouldn’t not acknowledge the conversation and instead kept telling me that it was my responsibility. Answer: Thank you for your question. My name is Jon Pinkus and I am an employment lawyer at Samfiru Tumarkin LLP. If you were permitted to take the shift off and can prove it, then the company will owe you severance and this will be a wrongful dismissal.
