Ask your question about terminations, dismissals and lay offs and an employment lawyer in Ontario, BC or Alberta will answer in minutes
2 weeks ago I got a mini-raise; I was told my review was postponed two more months, as I would be transitioning/promoted soon and they wanted me in my new position for about a month prior to review. 1.5 weeks later, I get demoted. The following day, I get terminated and signed and agreed to 4-weeks severance in exchange for not pursuing legal action and leaving the building immediately, which I have done. The following day, I am told in an email they are under the impression I'm going to 'hurt' them, have cancelled and bounced the cheque (since it had a 2-3 day hold), and have asked me to accept a new cheque and to sign a new termination with additional clauses added. I have asked to reinstate my severance pay by the following business day. Are they allowed to do that? Decide on their own the termination agreement we just agreed to, is no longer valid?
Thank you for the detailed question. Typically, when you sign a release, there is little that can be done. In your case, the new offer would invalidate the initial offer and you are entitled to severance. I would encourage you to call us and have one of our employment lawyers fully review your matter (1-844-661-9065). In the meantime, please visit the severance pay calculator our firm has developed to see what you are owed (www.SeverancePayCalculator.com).
