Ask your question about terminations, dismissals and lay offs and an employment lawyer in Ontario, BC or Alberta will answer in minutes
I am currently in an acting position and receiving the pay of that position. Due to the way the absent employee is inputting leave I am being denied a Term of employment in that position that I would otherwise be entitled to if the employee were inputting leave correctly, a term which comes with the benefits and sick/vacation leave of the position. I am receiving half the ammount of leave and benefits because I am a regular half time employee if I were not acting. I have been acting for more than 6 months, and so has the employee replacing me while I am acting: My union's contract outlines this scenario for casual employees but not regular, so the casual employee filling my position has been given a term and benefits, and I have not. My union has told me that this is happening because they never accounted for this situation while making a contract. Do I have any right to the benefits of the acting position I am in?
Unfortunately, the only person that can answer that question is your union rep.
