Need advice on if I was wrongfully terminated or not... A couple months prior to this situation, I had misread the schedule & got written up which was understandable. That was my first write up. This school year, I had class on Tuesdays 6:30-9:30pm & I got scheduled to work at 5pm. I had asked another worker & got it switched. We received our schedules every Wednesday & I discovered that I was scheduled at 5pm on Tuesday, again (this was March 15, 2016). I asked every employer in my section & no one was available. I posted in our work group chat & no one was able to cover it. That following weekend I changed my availability to exclude Tuesday evenings. That following weekend I also verbally informed my manager BOTH Saturday & Sunday that I could not work on Tuesday & had done all means to try & get it covered. He said okay & I assumed it was dismissed. On Tuesday, I received a voice mail from one of my managers telling me we would discuss what would happen the next shift I worked which was March 17, 2016. I went into work March 17 & I got fired. I was employed at this job in February of 2015 & I got fired over two shifts. I would argue that I was one of the best workers in my section. I was very organized, quick & efficient, & I was always trying to find a way to help my coworkers in their sections. My manager always told me that if I had tried every possible action to cover my shift & it was impossible, let them know & they would figure it out. There has also been a few cases with other employers who have been written up more than twice & are still working there. One of them is now a part-time manager!?!?! The last note I need to make would be the fact that another employer in my section got promoted before I did & I got hired before her. I know that is a result of our success within the company, but I have been told I was never offered the position because I am so good at doing my job in my current position, they want to keep me there. I feel as if I have been treated unfairly & although they had a cause for termination, I do not believe it was a fair cause... I am still angry about this situation & I don't think I will ever get over it. Do you think I was wrongfully terminated? Is it something worth looking into?

Two minor incidents of the kind you describe would not likely be enough to constitute cause and you would be entitled to notice or payment in lieu thereof. Please contact us at the number below for a consultation to discuss your employment situation and entitlements.
