I am being asked to sign an employment contract that says I may be terminated without just cause at the sole discretion of the employer with a minimum amount of notice. that I agree that I will not receive any further or additional severance payments. is that legal

Hi Mary,

Thank you for your question.

It is legal for your employer to limit your entitlements following a termination “without cause” to the minimum payments and benefits prescribed by the relevant employment legislation.

However, and despite your contract attempting to limit your entitlements in this manner, it also depends on the precise wording of the contract itself and the circumstances surrounding your execution of the contract. It is very possible that, in the event of a termination, you would be entitled to much more compensation than the contract suggests.

I would highly recommend that you contact our firm as soon as possible so that we can properly advise you and so that you are fully aware of the impact your employment contract will have in the event of a termination.
