clerical error when company reduced ours to 35 from 37.5, resulting in an overpayment. What are my obligations? They are asking for $6000 back, of which i do not have, nor was i aware of this overpayment, assumed salary all along.

Hello,

You may be required to pay this back if you did not actually work/earn that money, even if it was a clerical error by the company. If you cannot pay it all at once you may want to ask for a payment plan. However, whether you are required to pay it could depend on how long ago it was paid to you and how long it took the company to fix the mistake. You should contact our office to schedule a consult with one of our employment lawyers so we can review your matter fully and determine the best course of action for you.
