Ask your question about terminations, dismissals and lay offs and an employment lawyer in Ontario, BC or Alberta will answer in minutes
My company is trying to change my contract for the second time in 6 months. They are now trying to change my job focus (basically adding a ton of new duties in another field) and taking away my ability to earn commission. They also mentioned in a phone call they are hoping to get feedback tomorrow, and in the summary email they sent they are basically imposing these changes with a line in bold saying "All of the following changes would go into effect July 1, 2022." And well today is June 14 th. I should mention that they are trying to increase my base salary by $10K/yr but my commission (with their last Quarter goal) can reach $20K on the next 6 months alone. My question is, this sounds very much like Imposing Fundamental Changes to my contract, and I am wondering if there is a time frame they have to give me for me to accept or decline by law? Seems 2 weeks notice to be a very small timeframe to accept or decline this changes.
I would agree that this sounds like it could be a constructive dismissal which would entitle you to decline the changes and fight for your severance package. In terms of timing, there is no exact time period by which you have to accept or decline then changes and it depends on your specific circumstances.
