Ask your question about terminations, dismissals and lay offs and an employment lawyer in Ontario, BC or Alberta will answer in minutes
I have been with my current employer for over 10 years as a manager. Just recently the senior manager started imposing different rules on my style of work. He has been putting my management style down in front of the staff and indicating that they are not being managed properly (indirectly implying me as the manager). I took time off because of the stress the situation is causing me. I have close to 10 weeks of paid sick time with my employer. I gave a medical note indicating that I will be off for 3 weeks for stress related issues. My HR has told me that I will be contacted by the insurance company regarding my absence. I don’t understand why my medical leave needs to “validated” although I have provided a medical note and I still have paid sick leave available. I feel like the senior management is looking for a constructive way of dismissing me. Do I have any rights as an employee? This situation is further adding stress for me.
Thank you for your question. It is possible that your employer has outsourced it's administrative responsibility regarding medical leaves to an insurance company. That said, as long as you have the support of your treating physician, you should not have any issues regarding your medical leave. If your employer or the insurance company rejects your medical leave or begins to give you a hard time on the issue, please give us a call immediately at the number below. We would be happy to discuss the situation in detail and give you proper advice.
