I have a doctors note from Nov 8-11 due to a severe sprained ankle which has left me from not being able to put any pressure on it. My boss has asked me to come in if he puts in my his office where I am only doing paperwork and not moving around. I went in today to because of pressure and trying to be helpful, I have been moving around which has left my ankle in more pain. Does he have to obey my doctors note?

Hi Sarah,

Thank you for your question.

Generally speaking, there is a duty on an employer to accommodate an employee's disability, provided that the disability is supported by medical evidence and that in accommodating the disability the employer does not suffer "undue hardship".

In this case, given that your disability is only expected to impact you for a few days and the disability itself does not require too much accommodation, your employer should obey the note and accommodate you accordingly.

If your employer refuses to accommodate your disability and you cannot work without some form of accommodation, you may have a viable claim against your employer. In that event, I suggest you contact our firm where we can discuss your options together.
