If an employee is let go due to poor performance , is the announcement to remaining staff permitted to say X employee is no longer with the company due to poor performance ?

Thank you for your question. My name is Jon Pinkus and I am an employment lawyer with Samfiru Tumarkin LLP. It would be inadvisable for an employer to do that, but technically it is not illegal.

The bigger question here is whether you have been paid an adequate severance package. The only way that an employer can terminate without paying proper severance is if they have just cause for dismissal, and establishing cause for dismissal on the basis of performance is extremely difficult.

We would recommend that you find out how much you may be owed at our Free Severance Calculator (http://www.severancepaycalculator.com/). If you have been paid less, please contact me at jon.pinkus@stlawyers.ca or at the number below for a consultation.
