I have an employee that has been on short term disability, she is returning to work in Sept but is being difficult on her duties for her return as per her doctor. She wants to meet to discuss what her future looks like but wants info that we cannot provide as we have no updates from her family doctor. We are unsure of her intentions and why she is pushing back and asking us for information that we cannot provide her as we have no information from her family doctor

Thank you for your question. This is a bit of a tricky issue that will need to be explored with an employment lawyer. While you have a duty to accommodate, your employee also has a duty to cooperate. As long as you are asking for appropriate information, it is within your right as an employer to insist on the required information from her treating medical professional in order to facilitate her accommodations. Generally, an employee who refuses to provide relevant information as to what accommodations they require is not entitled to accommodation.

It is strongly advisable to give us a call at the number below so that we can walk you through the best strategy to protect your company through this process.
