Ask your question about terminations, dismissals and lay offs and an employment lawyer in Ontario, BC or Alberta will answer in minutes
I have an employee who signed a letter with his new job duties, new annual salary last year,to date he has not performed the new duties, has stated that the issues are not his problems but are clearly outlined in letter. Basically he is not doing his job but is getting paid the new salary. We have talked about this in the past and there has been no improvement. He is a 25 year plus employee.
Have there been any sort of discipline? ie written warnings? Did the new contract of employment contain a termination clause? You will want to be careful with dealing with a 25 year employee as the potential notice/severance entitlement may be significant. I would recommend that you contact our office to discuss the matter with one of our lawyers.
