Ask your question about terminations, dismissals and lay offs and an employment lawyer in Ontario, BC or Alberta will answer in minutes
Is it possible for an employer to terminate an employee while they are on parental leave? Specifically if a single employee is a group is targeted for reduction, can they still be terminated if they are on parental leave?
Knowing that this is one employee in a group, and that employee is the only one targeted for reduction while the rest of the team would remain?
Thank you for reaching out to our firm. Generally speaking, the answer is yes. However, these can be very complex situations and it is important that you obtain legal advice prior to terminating the employee. There are other concerns surrounding terminations, including severance, which are also important to have a handle on before terminating someone.
