Ask your question about terminations, dismissals and lay offs and an employment lawyer in Ontario, BC or Alberta will answer in minutes
Can I fire an employee for making racist comments to one of my customers
They have said they don’t want my services if he will be the one to do it
Thank you for your question. My name is Jon Pinkus and I am an employment lawyer at Samfiru Tumarkin LLP.
You can always terminate your employees without cause and pay them severance, but the question will be whether this comment fundamentally breaches the trust you have in this employee such that it reaches the level of just cause at law. If you have just cause for dismissal, you may be able to avoid paying some or all of the severance that would otherwise be owed.
In order to make that determination, some more information will be required. I recommend that you email me at jon.pinkus@stlawyers.ca so that we can discuss your options.
