If you are Givin 17 weeks warning that your company is moving out of town....can your employer deduct those 17 weeks from you severance pay?

Hello Cidalia,

The 17 weeks notice that your company provides does count toward your overall termination entitlements. However, with respect to any severance pay entitlements you may have under the Employment Standards Act, your employer cannot provide your severance payments by way of working notice (it can only provide your termination pay entitlements by way of working notice). In any event, it is always a good idea to contact a lawyer to review the circumstances of your termination and any termination entitlements you may have.
