Ask your question about terminations, dismissals and lay offs and an employment lawyer in Ontario, BC or Alberta will answer in minutes
good morning- I enjoy your show on 640 and am a regular listener and in-house counsel for a Toronto development firm. Here is my question. Our company had an employee (a construction site superintendent) who resigned in his 14th week of work with us, and gave no notice whatsover. Are we permitted to withhold pay for his last 2 weeks of work (for his failure to give us any notice, or any other reason)? Also, is he entitled to any vacation pay? Thank you,
No, you cannot withhold any payment owing, under any circumstances. All employees accrue vacation pay at the rate of 4% of income (unless an employment agreement calls for more than this)
