Ask your question about terminations, dismissals and lay offs and an employment lawyer in Ontario, BC or Alberta will answer in minutes
I am going on maternity leave in April of 2026. My employer has stated that they will be withholding my 2025 bonus, which is also paid out in April of 26 as they "don't want to disrupt by EI benefits" while on leave. Is that legal? Does my bonus count as earnings for 2026 or 2025?
Thanks for your inquiry. Your bonus payment will potentially impact EI benefits depending on when it is paid. If your bonus is earned in 2025, but payable in 2026, it will contribute to your 2026 earnings. We will need to review additional details to properly assess your situation.
