We are planning on closing a business by the end of June this year. We have 3 employees, one has been with us for 32 yrs, the other 11 and the third 8. We have given them notice already. We are a small business and payroll is a little over $100,000 annually including us. How much should we be paying our employees in severance pays?
Unless you have a payroll of over $2.5 million then your employees are not entitled to severance pursuant to the Employment Standards Act. However, unless the employees signed employment agreements which limit them to the ESA minimums they are entitled to common law notice, which can be very significant.
