At present I am lay offs Temporary n with unpaid since last 3 months. My Manager is saying- you can continue your work when you come back . But I wanna go for EI. Will I be eligible to get EI benefits or not?

For questions about the administration of government benefits such as Employment Insurance, the best way to receive an answer about whether you will be approved is to contact Service Canada because they administer the government benefit and determine eligibility. If you have been laid off, and there is no contractual right of your employer to place you on a layoff, then, subject to the rules in your Province, you may be constructively dismissed. When an employee has been constructively dismissed, they are entitled to a severance package. Each claim will depend on your specific circumstances and the Province you are located in, and it is best to have your potential claim reviewed in more detail by counsel located in your Province. I recommend that you contact our office for a complete review.
