i have a question about termination in alberta
we have this one employee who the company does not prefer to keep any longer because he is getting a little lazy with the work
is it fine to give a 1 week notice and fire him without cause. if thats fine, should severance pay need to be given separately?he is just 9 months old in the company.

An employer generally has the right to terminate an employee on a without cause basis by providing the employee with reasonable working notice of termination, or, by paying salary in lieu of reasonable notice.

At minimum, the employee is entitled to termination pay in accordance with Section 56 Employment Standards Code. For an employee who has been employed 9 months, the minimum payment is one weeks' pay.

In addition to this, the employee may be entitled to severance pay. Severance pay can be offered in an exchange for a signed Release which protects the Employer from any other potential claims made against the Employer.

We would recommend that you book an appointment with employment lawyer to review the circumstances of employment , make a recommendation as to the severance range, and to assist with drafting a Release to protect the Employer.
