I own a small hotel that has seen at least a 70% reduction in Revenue due to Covid however I have kept all my staff of 9 working instead of closing as I didn't want their families to not have income. Obviously it is a huge financial burden. I had a total Business Review done under a government grant and they have recommended I hire a Marketing person for a few hours a week which obviously I can't afford. I have determined I could hire a new Front desk employee with Marketing skills to do the job along with Front desk duties but none of my current employees are capable of that. One in particular is retirement age and has been repeatedly reprimanded for not following rules, sleeping on the job, ignoring dress protocols etc. I believe she is using the job to get away from her elderly father who is the sole person in her house and her only social life. She is 65 and been with the Company for 4 years. I would like to replace her with someone who can do both jobs . What are my rights and responsibilities in this situation. How much severance do I need to pay if it is possible to let her go. I am doing everything I can to keep the business afloat so we will still be here for all employees once Covid is over.

In the circumstances, it would be best if you speak to one of our lawyers to determine the appropriate severance package for your employee in the event you choose to terminate her employment without cause. We can certainly assist you in determining the best way to approach this situation but will require some additional details from you including her length of service, and other factors. Please contact our offices to set up a consultation.
