I want to terminate a staff still in probation period. How can I address this?

How long is the probationary period? Is there an employment contract which stipulates the probationary period? Under the Employment Standards Act there is no minimal notice requirement for employees who have worked for less than three months. However, the employee may still have common law entitlements.
