Can I dismiss an employee with cause if she has had 2 warnings to stop whispering to employees making them feel uncomfortable and creating a negative environment and to stop interfering in other employees business. She told an employee to take time off and jot get a drs letter

Hello and thank you for your question.

Although you have done the right thing by issuing two warnings, it is nevertheless extremely difficult to terminate an individual's employment for just cause. In order to adequately assess whether the company has cause to terminate in this situation, I require additional information from you. Remember - you are always free to terminate the individual's employment without cause if you are worried about a potential wrongful dismissal claim. Please contact me at andrew.goldberg@stlawyers.ca to arrange for a consultation if you wish to discuss your matter further. I would be happy to assist.
