We are an employer, our building has been sold and we are in need of a new location. My concern is do we owe our employees something for distance/relocation? If we move 20-25km for example

Hi Rob,

Thank you for your question.

There is no bright line as to how many km or how many more minutes of a commute each day could constitute a constructive dismissal (a significant change to the terms of employment), which would entitle those employees to the same entitlements they would have in the event of termination.

I can however say that an additional 30-45 minutes of a commute each day would be highly unlikely to amount to a constructive dismissal. If we are talking about adding another hour or more onto the daily commute, it could be a bit more of a risk, but it seems as though that is not the case in your situation.

If you would like to discuss any further specifics feel free to give our firm a call. From there we can schedule a consultation and address any further questions or concerns you may have.
