Ask your question about terminations, dismissals and lay offs and an employment lawyer in Ontario, BC or Alberta will answer in minutes
Hi. I have three years of employment with this company, that was recently bought by another bigger fish. Today on Dec 14, 2016 I am provided with new contract which states employment star date Jan 1, 2017 not taking under consideration my three years until the acquisition. This new contract has also a three months probation period stipulated, with an open option for the employer for termination without cause during the three months period. I want to know if through the acquisition process the contract should be a transfer of employment with the start date back in 2013 and no probation period giving the years with the company. There is also no mention about the hours/day to be completed (no matter the schedule) for the annual salary and no mention about sick policy. Thank you in advance!
The new company cannot cancel your previous years of service and while it can let you go shortly after the transfer it will owe you termination pay. I encourage you to call us at the number below before you sign a contract with the new company as we can help you to review and understand the terms and their practical implications on your entitlements.
