Can I get my severance if I am on sick leave? Our only full time employee, seasonal business and hired one to two more employees in busy time, was terminated last September. We sold the business and gave him notice on Sept. 1, 2016 and paid him to Sept. 30. His DOH was August 8, 2013. He worked hourly until Jan. 1,2014 and then replaced the manager we had. At the time of hire it was agreed that he did not want to do timesheets and if and when he worked OT he would take it is time in lieu. Upon termination he said we owed him over 10,000.00 in time and lieu for OT hours (over 44) and extra hours(over 40 hour ) . He also claimed we did not pay him enough severance. He told us upon termination thAt he had been keeping timesheets on the computer from Jan. 1,2014, we were not aware of ny timesheets. He also handed us a copy of the timesheets a week or so later. He filed a claim with the MOL in Ontario on Oct. 27,2016. Upon reviewing our notes we noticed that the timesheets he supplied and the ones that he had been keeping on our computer were different and also we saw that the file was not even created until Sept. 29,2015. We were told by MOL to settle and we now have a meeting with them on Sept. 12' 2017. We do not think we wronged him in any way as the timesheets are false as far as we can tell from our work calendar. Any advice?I am a dog groomer, and when hired, I was told I would be classified as a sub contractor. I am paid 50% commission on all the dogs I work on, I do not book my own clients, and pay for no supplies but my own grooming equipment. I have read the information online about independent contractors, but it says "exceptions for hairdressers", and I felt this might apply to dog groomers as well, but it doesn't say what the exceptions are. My boss has been employing people this way for years, but I'm not 100% sure I'm properly classified.I fired my nanny due to poor work standards and care.
